Eric Nana Agyemang-Prempeh – Director General of NADMO
An Accra High Court (labour division) has dismissed an interlocutory injunction application filed against the National Disaster Management Organisation (NADMO) by some 133 District Directors against their demotion and transfer.
The aggrieved workers had sued NADMO and its Director General, Eric Nana Agyemang-Prempeh for transferring them from their posts to a new job as “ordinary staff”.
Even before the merit of the case was looked into, the 133 workers filed an interim injunction against NADMO praying the court to order the company to reverse its decision and reinstate them to their previous roles.
According to them, the decision by the company to appoint new directors to replace them constituted an illegality.
The court, however, threw the interim application out and subsequently ordered the applicants to expunge the name of the Director General, Eric Nana Agyemang-Prempeh, whose name had been attached to the suit.
The court also ordered the aggrieved workers to within 14 days amend their writ to reflect as 133 directors against NADMO.
The 133 Metropolitan, Municipal and District Directors went to court to challenge the decision by NADMO to transfer them to different offices.
According to them, the demotion was done without recourse to the conditions of service of NADMO and in contravention of the Public Services Commission’s Regulations.
They claimed that they were given just a day’s notice to report to their new posts and were threatened to be dismissed if they fail to comply.
The substantive matter is yet to be determined by the court.
