Renowned actor, Jamie Foxx, has vehemently denied the recent sexual assault allegations lodged against him, with a spokesperson stating that the purported incident in August 2015 “never happened.”

Responding to the lawsuit filed by an individual referred to as Jane Doe, the representative told PEOPLE, that the claims are identical to a 2020 case filed in Brooklyn, which was subsequently dismissed.

“We are confident they will be dismissed again,” the spokesperson asserted. Furthermore, Foxx intends to pursue a claim for malicious prosecution against the accuser and her attorneys once the allegations are dismissed.

In the lawsuit, filed under New York’s Adult Survivors Act, Jane Doe detailed an encounter at Catch, NYC, where she alleged Foxx assaulted her. She claimed the actor, seemingly intoxicated, complimented her appearance and subsequently led her to a secluded area, where the alleged assault took place. The lawsuit seeks unspecified damages for pain and suffering, economic loss and other injuries.
