Hotel Investments (Ghana) Limited, operators of Labadi Beach Hotel, has filed an application to discontinue a suit it filed against Spartan Ives Limited, operators of Polo Beach Club, over a piece of land at the beachfront.
The application was filed just three days after lawyers for Polo Beach Club filed a motion to restrain the hotel, allegedly acting through the Director of Special Operations at the National Security Council Secretariat, Richard Jakpa, to demolish the Club.
“PLEASE TAKE NOTICE that this Honourable Court will be moved by FIFI ABBAM, ESQ. Counsel for and on behalf of the Plaintiff/Applicant herein, praying for leave to wholly discontinue the action against the Defendant/Respondent with liberty to reapply on the grounds contained in the accompanying affidavit, and for any further order(s) as this Honourable Court may deem fit,” the motion which was filed on notice pointed out.
Labadi Beach Hotel, on March 18, 2026, caused its lawyers to file an amended writ of summons and statement of claim against Polo Beach Club claiming ownership of the disputed beachfront land.
Counsel for the Club entered appearance and proceeded to file further amended defence dated August 3, 2026.
A High Court in Accra has since set down issues to be determined at trial, and subsequently directed the parties to file their respective witness statements.
But the latest application filed by the hotel indicates that the plaintiff intends to discontinue the suit following reassessment of the cost and operational impact of the legal action.
“That following a reassessment of the costs and operational impact of the suit, the Applicant is desirous of wholly discontinuing this action against the Respondent,” the application partly reads.
The hotel, however, pointed out that the decision is a “commercial one”, noting that “it does not constitute an admission concerning the merits of the action or the rights asserted by the Respondent.”
The hotel is, therefore, praying the court for leave to discontinue the suit against the Club “with liberty to reapply.”
It further pointed out that the court has the power, pursuant to Order 17 of the High Court (Civil Procedure) Rules, 2004 (C.I. 47), to grant the applicant leave to discontinue the suit against the Club.
“It is in the interest of justice that this application be granted,” the affidavit in support of the application added.
