Gregory Afoko and Asabki Alangdi

Gregory Afoko, the prime suspect in the murder of the Upper East Regional Chairman of the New Patriotic Party (NPP), Adams Mahama, has filed a motion at the Supreme Court to challenge the Attorney General’s decision to discontinue his trial at the High Court.

In effect, his lawyers are attempting to put on hold the preliminary hearings at an Accra Central Magistrate Court until the final determination of the motion by the Apex Court.

Wait For Cue:

Gregory Afoko was put before an Accra High Court in 2016, charged with the murder of the late Adams Mahama.

The case was nearing its conclusion after the state had called 14 prosecution witnesses including the wife of the deceased to prove its case.

The accused also opened his defence in December last year and denied the charge of murder preferred against him by the state.

The court presided over byJustice Lawrence L. Mensah had ordered the parties to file their statements, with a date fixed for both sides to take turns to address the court before the jury decides whether the accused was guilty or not.

But the Attorney General on January 28, 2019 entered Nolle Prosequi to discontinue the matter.

This followed the arrest of Asabke Alangdi, another suspect in the murder of Adams Mahama who had been hiding in Burkina Faso after fleeing the country.

Appearing before the Magistrate Court yesterday, Benedicta Antwi who held the brief of Osafo Buabeng, counsel for Afoko, told the court that they had filed an application at the Apex Court to challenge the Nolle Prosequi.

But the presiding Magistrate, Afua Sackey said she does not have a copy of the application and gave the lawyer three days to serve the other parties as well and make sure the court gets a copy of the application.

Hearing continues on Monday February 18, 2019.

Gregory Afoko and Asabke Alangdi are before the Magistrate Court charged with two counts of conspiracy to commit crime and murder of Adams Mahama who died of severe acid burns.

The two suspects who have been accused of pouring acid on the late NPP member were remanded into Bureau of National Investigation (BNI) custody awaiting trial.
