Banker Sued For ‘Embezzling’ GH¢75k

 

IKSON PROPERTIES Agency Limited in Tema has filed a suit against Mercy Agyei, a banker with the Adum branch of Absa Bank Ghana Limited in Kumasi, for allegedly embezzling GH¢75,000 belonging to the company.

The suit filed at a Circuit Court in Kumasi by Yawson Otoo, Chief Executive Officer (CEO) of the company, is seeking an order of the court for a refund of the money with interest beginning from November 2, 2023 until the day of final payment as well as cost, including legal fees.

The plaintiff avers that Madam Agyei worked as an intern in the marketing department of his company after she was permitted to undertake her mandatory industrial attachment between September and November 2019.

A statement of case filed before the court contends that the defendant was sent to collect GH¢75,000 from Electroland Ghana Limited at Kaase near Kumasi on behalf of the company.

The plaintiff claimed that the defendant collected the money on November 2, 2023, issued an official receipt in respect of the payment, but refused to pay it into the company’s account even though she told the CEO she had done so.

The suit further contends that an audit of the company’s accounts this year revealed that the defendant did not deposit the said GH¢75,000 in the company’s account.

A formal complaint was subsequently lodged with the Asokwa Divisional Police Command in Kumasi, but investigation has since not been completed for criminal trial to commence.

Defence

Meanwhile, Madam Agyei has denied the allegations made against her by the plaintiff, and insisted that the CEO only asked her to help him collect GHȼ70,000 from Electroland Ghana Limited.

According to her, at the time Yawson Otoo requested her assistance, she was already working with Absa and was no more with the plaintiff’s company.

She described the plaintiff’s claims as frivolous, vexatious and intended to deceive the court and must be dismissed.

Petition

Meanwhile, Yawson Otoo has petitioned the Attorney General’s Department over the delay by the Asokwa Divisional Police in prosecuting the suspect in a criminal case since June 2024.
