The new BA NDC Regional office
Vehicles and a new building of the National Democratic Congress (NDC), which is under construction, have been attached under a writ of Fi.Fa issued by a Sunyani High Court for failing to adhere to the court’s order to pay GH¢1,500 to a plaintiff, who is a member of the party.
The writ of Fi.Fa was issued by the court last Tuesday after the plaintiff, Raphael Cubagee reported back to the court that the defendant- NDC had failed to pay him GH¢1,500 that it awarded in his favour.
Per the issuance of the writ of Fi.Fa, the NDC cannot continue to build its new regional headquarters located at Sunyani New Town.
The building has now become the property of the court and would be valued and auctioned if the party fails to pay the fine within a stipulated time.
In an interview with DAILY GUIDE, the plaintiff, Raphael Cubagee, said the party disqualified him in 2014 in the race for regional chairmanship position for no reason.
He subsequently filed a suit against the party on September 3, 2014 at the Sunyani High Court.
The judge, he said, dismissed the case and advised that the case be settled out-of-court.
The plaintiff appealed against the decision and this time round it was upheld and an injunction was placed on the party’s regional election that was slated for 8th September, 2014.
The party disregarded the injunction and conducted the elections.
As a result, the National Chairman, the B/A Regional Chairman, the National Communication Director and the Regional Secretary of the NDC were cited for contempt of court.
When the case was later called, the four personalities failed to appear before the court.
Although their lawyer, Appreku Nketia appeared in court, he failed to respond to the issues but sought an adjournment.
As a result, the court slapped a fine of GH¢1,500 for contempt of court but NDC refused to heed the order.
The plaintiff therefore went back to court and filed for an order of Fi.Fa.
Items affected by the court’s order include a Mahindra car with the registration number NR739 and other vehicle of the respondent.
“A writ of Fi.Fa dated at 9th day of September, 2016 at Sunyani has been issued under the hand of her ladyship, the Chief Justice at the instance of the judgment creditor, Raphael Cubagee for the attachment of movable and immovable property of the judgment debtor, National Democratic Congress in the above named suit. The said judgment debtor is hereby prohibited from alienating the property by sale, gift or in any other way and all persons are hereby prohibited from receiving the said property by purchase, gift or otherwise,” it said.
