The Tarkwa High Court in the Western Region has granted an interlocutory injunction to restrain the Wassa Fiase Traditional Council from recognising Emmanuel Assuah Nyami, also known as Okatakyie Ntsiful Essel V, as President of the Traditional Council, pending the final determination of a substantive suit.
The plaintiffs/applicants in the case were Nana Kwasi Sackey and Abena Konajuoa II, while the defendants/ respondents included Emmanuel Assuah Nyami, Madam Nyameke Adjoba, Ebusuapanyin Charles Meiza Nda Blay and Wassa Fiase Traditional Council.
The court, presided over by Her Ladyship Mercy Adei Kotei, also restrained the fourth defendant whether by itself, its officers, agents, or assigns from recognising, permitting, endorsing, or allowing, the first defendant to perform, exercise, or be accorded any powers, rights, functions, duties, or privileges.
It also barred the first, second and third defendants, their agents, assigns, or representatives from receiving any royalties, payments or financial benefits from the fourth defendant meant for the plaintiffs’ Royal Asomankoma Family of Benso, pending the final determination of the substantive suit.
The court again restrained the fourth defendant, its officers, assigns, or agents from disbursing or making any payments of stool land royalties, or any other financial entitlements, emoluments, or traditional benefits that are due to the plaintiffs’ Royal Asomankoma Family of Benso to the first defendant.
“Whether directly or through any person, institution, or entity, pending the final determination of the substantive suit,” the court indicated.
