Daddy Lumba Case: Akosua Serwaa Heads To Court Of Appeal

A fresh legal showdown has erupted over the number of spouses of the late highlife legend, Charles Kwadwo Fosu, popularly known as Daddy Lumba, as Akosua Serwaah, the first wife, has filed an appeal at the Court of Appeal in Kumasi to overturn a High Court decision that recognised two surviving spouses.

The disputed ruling, delivered by the Kumasi High Court, declared both Akosua Serwaah and Priscilla Ofori, widely known as Odo Broni, as lawful spouses of the celebrated musician.

Unhappy with the outcome, Ms Serwaah has mounted a comprehensive challenge against the judgment, insisting that the decision was flawed both in fact and in law.

Central to her appeal is the trial court’s refusal to admit a marriage certificate she tendered in support of her claim. Ms Serwaah contends that the High Court wrongly rejected the document and, in doing so, misinterpreted the provisions of the Evidence Act, 1975 (NRCD 323), which governs the admission of documentary evidence.

She maintains that the exclusion of the marriage certificate unfairly weakened her case and led the court to an erroneous conclusion regarding her marital relationship with the late musician.

Ms Serwaah is now asking the Court of Appeal to quash the High Court’s ruling and to pronounce her as the sole lawful surviving spouse of Daddy Lumba, whose death sparked intense public interest and legal scrutiny over his estate and personal life.
