Controversial showbiz personality, Afia Schwarzenegger has allegedly been avoiding being served with the writ of summons issued by Chairman Wontum against her.
The Ashanti Regional Chairman for the New Patriotic Party (NPP) last week sued Afia Schwarzenegger for GHC2 million for defaming him.
The suit has come days after Afia alleged in a viral video that she has had sexual relations with Chairman Wontumi and that when they had sex he allegedly farts during ejaculation.
In the writ addressed to Afia, Chairman Wontumi is asking for “damages of Two Million Ghana Cedis (GHC 2,000,000.00) for defaming plaintiff. Cost including legal fees.”
He is also praying the court to let Afia retract and apologize for her comments.
He further prayed the court to restrain her from making any such comments about him.
However, DGN has gathered that the court bailiff is unable to serve the actress known in private life as Valentina Nana Agyeiwaa with the writ of summons.
Efforts to have access to her have since proved futile.
It had therefore become necessary to serve the processes by substituted service.
Substituted service of a document in relation to which an order is made under this rule, is effected by taking such steps as the Court may direct to bring the documents to the notice of the person to be served.
On Thursday, June 16, 2022, the writ of summons was published in the Daily Graphic after an order for substituted service was granted.
The rules allegedly demand that Wontumi’s counsel can pray the court for an order for Judgment in Default of Appearance if Afia fails to appear in court after the publication.
