Mr. Acheampong was brought before the court presided over by Susana Eduful on one count of defrauding by false pretence.
Prosecuting, Sophia Asiedu, who held brief for ASP Emmanuel Nyamekye, the prosecutor in the case, said the complainant, Solomon Kwebi, is a businessman resident at Garden Estate Teshie, whilst accused person Villey Acheampong is a businessman resident at Baatsona, Spintex.
She said in February 2020, the accused person advertised his six-bedroom uncompleted building at Baatsonaa, Spintex for sale through an estate agent, Kwadwo Owusu, a witness in the case.
“Complainant, together with the witness, met the accused person and they all agreed at a price of GH¢820,000.00 where the complainant made payments to accused person, some of which was paid through the witness and a receipt of payment issued to the complainant,” the prosecution said.
According to the prosecution, a total amount of GH¢700,000 was paid to the accused person by the complainant.
Sophia Asiedu said the complainant then demanded to see the document of the said building so that he could add the remaining GH¢120,000.00 to complete payment but to his surprise, the accused person sent him a text message telling him he had sold the same building to another buyer.
“The complainant then demanded his money but the accused failed to give same to him and through that, the complainant petitioned the Director-General/CID on 27 October, 2021.
He continued that on November 2, 2021, the accused person was arrested and in his investigation caution statement, said he borrowed the said GH¢700,000.00 from the complainant but not to sell his building to him.
“Accused person was shown the receipt of payment as well as the message sent to the complainant but he could not give any tangible reason as to why he issued the receipt and the messages,” it said.
Police then asked the accused person to produce the original copy of the documents of the said building but he could not produce same. Investigations at the Lands Commission revealed that the said land was registered in the name of one Kwadwo Adjei the same person who issued an indenture for the accused person,” she revealed.
The prosecution said their further investigations revealed that accused used the original land title certificate to acquire several loans at DCI Microfinance Limited and after investigations, he was charged with the offence.
The case has been adjourned to April 27, 2022 by the court.
